Dark Entries Design LLC Terms And Conditions
For Virtual Interior Design Services
BY PURCHASING A VIRTUAL INTERIOR DESIGN SERVICES FOR YOUR SPACE(S), YOU AGREE
TO FOLLOWING TERMS AND CONDITIONS SET FORTH BY DARK ENTRIES DESIGN LLC:
1. Virtual interior design services are an online decorating consultation service only. All recommendations are regarded as suggestions to improve the look of your space and not intended for construction purposes.
2. Client agrees to provide full information regarding the client’s requirements for the project. Dark Entries Design LLC is not responsible for inaccurate information provided by the client.
3. Dark Entries Design LLC will perform services as expeditiously as is consistent with professional skill, care and the orderly progress of the virtual interior design plan.
4. Virtual interior design client agrees to correspond in a timely manner through online communication (and/or phone if client desires).
5. Dark Entries Design LLC will not be responsible for the means, methods or procedures of construction, fabrication, delivery & installation, or safety precautions in connection with the project; for the acts or omissions of the contractor, or any subcontractor, supplier, or other person performing the work on the virtual interior design project; or, for any failure of them to meet any schedules or completion dates.
6. Dark Entries Design LLC makes no warranties with respect to the service or deliverables of other third party entities or participants in design process. In this agreement Dark Entries Design LLC provides it’s virtual interior design services “as is”.
7. In no event shall Dark Entries Design LLC be liable to client for any indirect, special, exemplary or consequential damages, including any implied warranty of merchantability or fitness for a particular purpose or implied warranties arising from course of dealing or course of performance, lost profits, whether of not foreseeable or alleged to be based on breach of warranty, contract, negligence or strict liability, arising under this agreement loss of data, or any performance under this agreement.
8. Dark Entries Design LLC cannot be held responsible for arranging repairs, replacement or freight claims for purchases made in conjunction with recommendations for virtual interior design plan.
9. In no event shall Dark Entries Design LLC be liable to client for damages in excess of all amounts paid to Dark Entries Design LLC by clients under this agreement. The foregoing limitations shall apply to the maximum extent permitted under law
10. Payment in full is expected prior to initiating the design phase of the virtual interior design plan. Dark Entries Design LLC reserves the right to charge an additional fee if revisions of the final virtual interior design plan exceeds 2.
11. Affiliate links may be included in the client’s final shopping list. This means Dark Entries Design LLC earns a small commission from the client’s purchase at no additional cost to them (i.e. no markup).
12. Due to the nature of online shopping, products may go out of stock if the client delays making item purchases. Dark Entries Design will provide an alternative item if client notifies the Company within 30 days of final design plan delivery. Dark Entries Design is not responsible for changes to item prices, return polices, or any purchased goods and products which are valid as of the time of final design delivery.
13. Dark Entries Design LLC retains and shall own all right, title and interest in and to Dark Entries Design LLC Intellectual Property. Wherein, any and all design, formula, processes, design ideas, and any other materials of information at the time of service shall be retained by Dark Entries Design LLC.
